Terms of Service

1. Acceptance of Terms

By accessing or using the Chronotek Pro platform, mobile applications, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Chronotek Pro provides cloud-based workforce management software including GPS time-clock functionality, employee scheduling, team messaging, job costing, and payroll preparation tools for businesses with remote and mobile teams.

3. Account Registration

You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to update this information to keep it accurate. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

4. Subscription and Billing

Chronotek Pro is offered on a per-active-employee, per-month subscription basis. A free 30-day trial is available without a credit card. After the trial period, continued use of the Service requires a paid subscription. All fees are billed in advance and are non-refundable except as required by law.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations.
• Attempt to gain unauthorized access to any portion of the Service or its related systems.
• Interfere with or disrupt the integrity or performance of the Service or its data.
• Reverse-engineer, decompile, or disassemble any portion of the Service.
• Use the Service to collect or harvest any personally identifiable information without consent.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described therein.

7. GPS and Location Data

The Service includes GPS time-clock features that collect location data from employee mobile devices at clock-in and clock-out events. As an employer using this feature, you are responsible for obtaining all required employee consents, providing appropriate notice, and complying with all applicable federal, state, and local laws governing employee monitoring and location tracking.

8. Intellectual Property

The Service and all content, features, and functionality are owned by Chronotek and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your internal business purposes during your subscription term.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Chronotek shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Termination

Either party may terminate the agreement at any time. Upon termination, your right to access the Service will immediately cease. Chronotek may retain data for up to 90 days after termination to allow for data export, after which it will be deleted in accordance with our data retention policy.

12. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Mecklenburg County, North Carolina.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
